Purchasing/Selling with Edinburgh Cask Management
It’s important to note that Edinburgh Cask Management is under no obligation to repurchase casks upon exit; however, we offer viable options should you choose to exit your investment.
As custodians of your casks, Edinburgh Cask Management will maintain proof of ownership, delivery orders, purchase invoices, and photographs of the casks. These records will serve as confirmation of your ownership.
Please be aware that the value of whisky casks, like any investment, can fluctuate. We provide general information to help you understand the whisky investment market, but we strongly encourage you to conduct your own research and seek professional advice to assess whether cask investment is right for you. If you require further guidance, feel free to reach out to one of our team.
Scotch Whisky is not subject to VAT on purchase value, or capital gains tax while maturing in a bonded warehouse. However, we are not tax advisors and we recommend consulting a qualified tax professional if you wish to explore the tax implications and potential benefits of investing in whisky casks.
Storage & Insurance
Your cask will be stored within a bonded warehouse throughout maturation. As the registered owner of the cask you will be subject to pay storage and insurance fees. These fees are dictated by the warehouse in which your cask is stored. If you have any queries regarding the associated costs involved in cask whisky ownership, please get in touch with our team who can give you more detail on these costs for the cask in question.
Insurance will cover any incidents of theft, fire or damage while your cask is stored in a bonded warehouse – although such incidents are rare in cask whisky maturation. As the registered owner of the cask, you have the overall responsibility to monitor your cask health via regauges and sampling, both of which you can request directly with the warehouse in which your cask is stored.
Should you choose to bottle your casks or sample the whisky, VAT will be applicable and must be settled before the cask or bottles can leave the warehouse. You, as the client, will be responsible for paying this.
Payment Terms
All payments are due within 7 days of receiving the invoice, unless agreed upon in writing beforehand.
Ownership of the casks will only be transferred once full payment has been received.
We accept payments via bank transfer, international bank payments and card payments subject to a nominal fee.
Prices listed on our website are in GBP.
Orders
Orders placed verbally or via email will create a binding agreement under these Terms & Conditions.
Although rare and unlikely, Edinburgh Cask Management reserve the right to cancel any orders and refund buyers at any time for any unforeseen circumstances. In this instance, Edinburgh Cask Management will endeavor to source a replacement cask in this instance.
Products
The cask details such as OLA/RLA and ABV are continually changing as casks are maturing. We always endeavor to have recent regauge reports for up to date information on the cask contents to inform buyers on the products they are purchasing. However, due to the nature of maturing whisky casks this is not always possible. As such, the buyer acknowledges and agrees to the following in relation to their order;
- The actual number of bottles produced from the cask is an estimate based on latest regauge results and may prove to be less or more than the informed quantity.
- Approximately 2.5% of the contents of each cask will evaporate through the wooden cask each year of the maturation period, which is an entirely natural process known as the ‘Angel’s Share’, and which will further reduce the estimated quantity.
- The cask strength of the liquid is not final until after bottling.
- The total price agreed/paid will not be affected or adjusted based on the content of the cask being above or below expectation.
Custody
After payment of invoice in full, and arrival of the cask at our partner warehouse, the buyer will require an account to be opened at our partner warehouse at no charge. The cask will then be transferred into the buyers account via a delivery order which is the legal title of ownership for the cask. The buyer will then be liable for all storage and insurance fees, and requests for any services or bottling will be direct between the buyer and the warehouse.
Governing Law
All contracts made with Edinburgh Cask Management are governed by Scottish Law and are subject to the exclusive jurisdiction of Scottish courts.
In accordance with alcohol legislation, we do not sell alcohol to individuals under the age of 18. By placing an order, you confirm that you are 18 years of age or older.
Force Majeure
Edinburgh Cask Management shall not be liable to the Customer or be deemed to be in breach of the Agreement by reason of any delay in performing, or any failure to perform, any of Edinburgh Cask Management’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond Edinburgh Cask Management’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond Edinburgh Cask Management’s reasonable control:
- Act of God, explosion, flood, tempest, fire or accident;
- War or threat of war, sabotage, insurrection, civil disturbance or requisition;
- Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
- Import or export regulations or embargoes; and
- Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Edinburgh Cask Management or of a third party).
